Problemas con el Plan Renove del Mueble en Cantabria

El Gobierno regional quiere analizar en profundidad la sentencia del Tribunal Superior de Justicia de Cantabria que ha anulado el Plan Renove del Mueble.

La Sala de lo Contencioso Administrativo del TSJC ha anulado el Plan Renove del Mueble de Cantabria por considerar que vulnera el principio de igualdad y libre competencia al excluir de la orden de ayudas a las grandes superficies. Se da así la razón a la Asociación Nacional de Grandes Empresas de Distribución (Anged) que recurrió la orden de ayudas aprobada por el anterior Gobierno de Cantabria con una cuantía de 5 millones de euros.
 

Ante esta situación, el Gobierno regional ha declarado que quiere analizar en profundidad la sentencia del Tribunal Superior de Justicia de Cantabria y ha anunciado la presentación de un recurso de casación, que permite alargar los plazos para interponer el recurso, en este caso podría haber margen hasta septiembre.

La consejera de Presidencia, Leticia Díaz, explicó ayer que lo mas sensato es presentar el recurso, pero se va a estudiar más a fondo. Si hay opciones de defender la postura del Gobierno se hará, y si los letrados dicen que no hay la mínima posibilidad, no.

Queda por determinar el alcance que el fallo del TSJC pueda tener para las arcas de la Administración regional. La demanda de la Anged reclamaba 5 millones de euros, montante del presupuesto destinado al plan, sin embargo ninguna de las partes implicadas quiere entrar a valorar aún cuáles serán las consecuencias del fallo de hacerse firme.
